Dispute Resolution — Binding Arbitration & Class Action Waiver
Please read this section carefully. It requires you to resolve disputes through binding arbitration rather than in court and waives your right to participate in class action lawsuits.
Before initiating any formal dispute proceeding, you agree to contact us at info@probatelawcenter.org and attempt to resolve the dispute informally. We will attempt to resolve any dispute within 30 days of receiving written notice. If we cannot resolve the dispute informally within 30 days, either party may initiate arbitration as described below.
Except for disputes that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at adr.org.
The arbitration shall be conducted by a single arbitrator. The arbitration may be conducted by telephone, online, or in person in New York, New York. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Each party shall bear its own costs and attorneys' fees in arbitration, except where applicable law requires otherwise or where the arbitrator determines that a claim was frivolous or brought in bad faith.
You waive any right to bring or participate in any class action, collective action, or representative proceeding against ProbateLawCenter.org. All disputes must be brought on an individual basis only. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
If this class action waiver is found to be unenforceable with respect to any claim, that claim must be litigated in court rather than arbitrated, but the class action waiver shall remain in full force and effect as to all other claims.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights or to address unauthorized access to the Site. You may also bring an individual claim in small claims court if your claim qualifies.
You may opt out of this arbitration agreement by sending written notice to info@probatelawcenter.org within 30 days of first using this Site. Your opt-out notice must include your name, email address, and a clear statement that you are opting out of the arbitration agreement. If you opt out, disputes shall be resolved as provided in Section 11 below.
Governing Law & Jurisdiction
These Terms and any dispute arising out of or related to your use of this Site shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
For any dispute not subject to arbitration under Section 10, or in the event the arbitration agreement is held unenforceable, you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in New York, New York. You waive any objection to venue or jurisdiction in such courts.
Copyright Complaints — DMCA
If you believe that any content on this Site infringes your copyright, you may submit a notice pursuant to the Digital Millennium Copyright Act (DMCA). Your notice must include:
